The Computer Misuse Act 1990 is an act created in order to prevent unauthorised access to computers. It can be divided into 3 parts.

Unauthorised Access to Computer Material:

  • This is when you access someone’s files/data without their authorisation.
  • There is a maximum 6 month penalty or a fine.

Unauthorised Access to Computer Material With Intent to Commit a Further Offence:

  • Accessing files and data belonging to someone else wanting to do something illegal. Commonly known as hacking. This can be used for all kinds of bad stuff, eg fraud.
  • Punishable by up to 5 years in prison or a fine.

Unauthorised Modification of Programs/Data on a Computer.

For example, creating viruses or changing data and records.

  • Since this modifies the sales bonus spreadsheet/data.

  • The intent was to defraud the business so that is also valid. In fact, all three answers here are valid!
